- Planning and Development Law
which is of paramount importance
particularly given recent developments in
planning legislation . From the time a
site is identified as a potential
acquisition, issues involving planning and
development law are among the most
important aspects of the transaction to be
considered in the context of the proposed
development of the site. We work closely
with other members of our client's
professional team, including architects,
planning consultants and engineers to
provide comprehensive advice in this
area.
- Environmental Issues
need to be investigated thoroughly in any
site acquisition and are of increasing
importance having regard to the
development of the legislation in this
area.
- Construction Law
including the drafting of the necessary
building contracts and ancillary
construction related agreements which are
required in many developments.
- Sourcing and negotiating project finance and dealing with loan facilities, agreements with lenders and assisting in negotiating security requirements and structuring security arrangements with banks.
- Joint venture developments and dealing with the various structures and agreements arising from this type of development.
- Licensing Arrangements, which involve devising the most appropriate structure for particular transactions and advising the client on the implications of this type of arrangement.
- Title issues including the review of title to land being acquired and land over which wayleaves or easements are required in respect of roads and services and providing advise for the resolution of any problems arising on title.
- Issues relating to services on sites, rights of way and easements - in this regard we work as part of the professional team to ensure that the client is entitled to access the required services and that the necessary capacity is available and advising on all rights, way-leaves and easements which may be required to facilitate development.
- Dispute Resolution - as part of the service to our clients, we also deal with disputes which arise in the context of land acquisition and development, and co-ordinate our services in this regard with our litigation colleagues.
- Preparation of Schemes of Development - the preparation of documentation for schemes of development has become much more complex in recent years with many schemes providing for a variety of residential unit types and, in many cases, a mix of residential and non residential units. We have the skill and expertise that is required to prepare the documentation necessary for various different structures so as to ensure that different schemes can be managed effectively.
- Sales of completed units - this is an area of fundamental importance to our clients and our aim is to ensure that sales are completed as quickly and as efficiently as is possible. We have a dedicated number of teams of highly trained professional and administrative staff in our new home sales department who have the necessary skills and experience to provide a streamlined and efficient service to our clients. The personnel in our new home sales department each work in conjunction with Partners within the Residential Property Development Department and are devoted exclusively to
co-ordinating and progressing sales of completed residential units. These teams co-ordinate and actively progress all aspects of the sale transaction, from the time at which sales instructions are received from our client or their selling agents, to the final completion of the sale. Each team liaises closely with the developer to which it is assigned and with their selling agents and undertakes a comprehensive reporting service to ensure that our clients have the most up to date information on individual cases on a daily basis.
